Why Lab Notebooks Matter After AIA

On March 16, 2013, the United States moved from its long-standing “first-to-invent” to a “first inventor-to-file” system under the America Invents Act (AIA). Before the change, lab notebooks were used to record the dates of invention. Under the current system, lab notebooks are still useful for record-keeping play an important role in the development and protection of a company’s intellectual property.

At this Lunch & Learn, you will be provided with insight on the important role notebooks continue to have for life science companies, including:

  • Inventorship – notebooks aid in the establishment of inventorship; critical for protecting the company’s patent assets
  • Grace period under AIA – for patent applications filed within one year of publication, notebooks can help establish that the published work is your own
  • Derivation Proceedings – notebooks can establish inventorship in this new post-AIA proceeding to resolve disputes between two patent applicants (think of your collaborations)
  • Trade Secrets – good recording-keeping is essential to maintain trade secret protection and to take advantage of the prior use defense to patent infringement
  • Interferences are still alive – under certain circumstances it may be possible to challenge a patent or patent application that was filed or claims priority prior to March 16, 2013
  • Export Compliance – the combination of virtual laboratory notebooks and the outsourcing of various functions may create export control compliance issues
