Antibodies are the fastest growing class of therapeutic large molecules. Differences in patent strategy, and patent law in different jurisdictions, can yield widely divergent economic outcomes for antibody products. These strategic and legal differences have a particularly significant impact in the world’s largest markets: the U.S. and Europe. Join us for a discussion of some key similarities and differences between U.S. and European law, recent changes in the law of both jurisdictions, and strategies to yield optimized claim scope in both jurisdictions with the same application.
This presentation will cover:

  • The United States Patent & Trademark Office’s position on written description and patenting antibodies.
  • Recent U.S. case law and guidelines, and what they mean for designing your patent strategy.
  • The European Patent Office’s position on patenting antibodies.
  • What to include in the patent specification to protect your antibodies in Europe.
