Navigating Advertising Challenges in the Medical Device Industry
In the United States, a variety of potential audiences, including regulators, competitors, and consumers, may scrutinize medical device advertising and other promotional activities for truthfulness. Potential challenges can be brought in multiple independent forums that apply different processes and standards, even while striving to achieve the same goal of preventing false or misleading advertising. While medical device firms often rely on the Food and Drug Administration (FDA) to ensure a level playing field, with enforcement at a historic low, many companies are frustrated with what they view as inappropriate promotional activities being undertaken by their competitors. Some of these companies feel the need to take matters into their own hands.
On June 25, join Danielle Humphrey and Rebecca Mandel for a complimentary webinar, which will address ways to navigate the terrain, both offensively and defensively, with particular focus on potential FDA enforcement and civil litigation.
